Planning for possible future incapacity is one of the most powerful things you can do to protect your autonomy.

Enduring Power of Attorney (EPOA)

  • Covers financial and legal affairs only.
  • Remains valid even if you become mentally incapable.
  • Does not cover health care or personal care decisions.

Representation Agreement (RA)

This is the main tool for health and personal care in BC:

  • Section 7 RA: More limited authority (personal care, health care, routine finances, legal services).
  • Section 9 RA: Broad authority over personal and health care decisions.

A Representation Agreement allows you to name one or more representatives to make decisions according to your wishes and values when you cannot.

Why This Matters for Mental Health

Having these documents in place before any mental health crisis can help ensure your voice is heard. While the Mental Health Act can authorize psychiatric treatment independently, your prior wishes (expressed in an RA or Advance Directive) can still influence care and demonstrate your values to treatment teams and review panels.

How to Create These Documents

  • Use official government forms (available on gov.bc.ca).
  • For complex situations, consult a lawyer or notary.
  • You must be capable when signing.
